The administration or recognition of religious courts is a form of religious accommodation present in many constitutional states today commonly analysed in legal pluralism terms. This article contributes to the further analysis of the relationship between legal pluralism and rights in religiously diverse societies by examining the status of state religious courts and their interaction with state non-religious courts. In particular, I examine what Cover calls “jurisdictional redundancies” between the courts and conceptualize the allocation of power between religious and non-religious (...) courts as a potentially productive site of interlegality. In doing so, I support concurrent jurisdictional allocations, arguing that exclusive jurisdiction could result in what I call an interlegal gap, whereby instead of inter-penetration of norms and production of reconciliatory principles, there is a justice gap whereby litigants may find themselves unable to obtain appropriate legal recourse including when neither court is willing to assume jurisdiction over the matter. This requires us to see the relationship between religious courts and non-religious courts through the more mundane but more practical lens of jurisdictional overlaps and competition, rather than through the more abstract framing of normative or even civilizational clashes. Accordingly, I argue that concurrent jurisdiction and interlegality have greater potential to strike a balance between individual and group rights and could be more protective of religious diversity. In other words, I argue for a closer, rather than a more separate, relationship between religious and non-religious courts, while denying that a hierarchical relationship where religious courts are subordinated to non-religious courts is the only way to protect rights. Background:Nurses exposed to community health nursing commonly encounter situations that can be morally distressing. However, most research on moral distress has focused on acute care settings and very little research has explored moral distress in a community health nursing setting especially among nursing students.Aim:To explore the moral distress experiences encountered by undergraduate baccalaureate nursing students in community health nursing.Research design:A descriptive qualitative design was employed to explore the community health nursing experiences of the nursing students that led them to have (...) moral distress.Participants and research context:The study included 14 senior nursing students who had their course in Community Health Nursing in their sophomore year and stayed in the partner communities in their junior year for 6 and 3 weeks during their senior year.Ethical considerations:Institutional review board approval was sought prior to the conduct of the study. Self-determination was assured and anonymity and confidentiality were guaranteed to all participants.Findings:Nursing students are vulnerable and likely to experience moral distress when faced with ethical dilemmas. They encounter numerous situations which make them question their own values and ideals and those of that around them. Findings of the study surfaced three central themes which included moral distress emanating from the unprofessional behavior of some healthcare workers, the resulting sense of powerlessness, and the differing values and mindsets of the people they serve in the community.Conclusion:This study provides educators a glimpse of the morally distressing situations that often occurs in the community setting. It suggests the importance of raising awareness and understanding of these situations to assist nursing students to prepare themselves to the “real world,” where the ideals they have will be constantly challenged and tested. On the basis of a report about Spinoza’s philosophy written down by Leibniz after some conversations with Tschirnhaus in early 1676, I suggest that Tschirnhaus may have had in his possession a manuscript copy of KV and that his account of Spinoza’s doctrine to Leibniz was colored by this text. I support the hypothesis partly by means of external evidence, but (...) mainly through a comparative analysis of Leibniz’s report and the doctrine contained in KV, showing that the report in important respects corresponds better to this text than to Ethics. I finally point to the importance that this hypothesis, if true, would have for our knowledge of Tschirnhaus’ role in the first diffusion of Spinoza’s philosophy outside Holland and for our understanding Leibniz’s reception of Spinoza in the mid-1670s. Neo-Skinnerianism differs from Radical Behaviorism in at least three important respects: (1) its willingness to entertain cognitive accounts of the processes underlying behavioral dispositions, (b) its reluctance to assert that the results of animal experiments can be used to predict and control human behavior, and (c) its ability to side step folk psychology's major criticism of operant theory. While eschewing Radical Behaviorism's ambition to transform psychology (and, indeed, human society itself), it nonetheless joins issue with a centuries-old debate over human (...) nature, and may eventually help to resolve it. Neo-Darwinism is based on the same principles as the Walrasian analysis of equilibrium. This may be surprising for evolutionary economists who resort to neo-Darwinism as a result of their dissatisfaction with Walrasian economics. As it is well-known, the principle of rationality does not play a role in neo-Darwinism. In fact, the whole (neo-)Darwinian agenda became popular exactly because it expunged the idea of rationality from nature, and hence, from equilibrium. It is less known, however, that the rationality principle is also (...) not central in Walrasian equilibrium analysis. Therefore, if we find that the rationality principle must be central to the analysis of decision making of human and nonhuman organisms, we must advance organomics . Organomics is bioeconomics understood as the use of rational choice to the study of the behavior of human and nonhuman organisms. Organomics offers a different starting point than the one offered by neo-Darwinism. (shrink)

In his late lectures, Foucault developed the ancient Greek concept of parrhesia, a courage to speak the truth in the face of danger. While not entirely uncritical of the notion, Foucault seemed to find something of an ideal in the political and aesthetic ideal of franc-parler, of speaking freely and courageously. Simultaneously, the post-1968 political valorized the ideal of parrhesia, or “speaking truth to power”: parrhesia seemed inherently progressive, the sole preserve of the left. But a cursory inspection of the (...) annals of Nazism and fascism shows that these movements also aligned themselves with parrhesiastical modes of expression. The fragmented, disparate strands of today’s neo-fascist revival, too, are closely imbricated with the notion of speaking valiantly in the face of supposed orthodoxies: in many ways, the preeminent parrhesiasts today are found on the neo-fascist side. This points to an essential weakness in the concept of parrhesia, particularly in terms of its value and valence as a strategy for the political left. Perhaps it matters less how we speak—being caught up in language games—than what policies and programs we enact. Žižek’s plea for a renewed dogmatic orthodoxy and Chesterton’s criticism of heresy offer ways out of the parrhesiastical trap. (shrink)

Confucius gave counsel that is notoriously hard to follow: "What you do not wish for yourself, do not impose on others" (Huang 1997: 15.24). People tend to be concerned with themselves and to be indifferent to most others. We are distinct from others so our self-concern does not include them, or so it seems. Were we to realize this distinctness is merely apparent--that our true self includes others--Confucius's counsel would be easier to follow. Concern for our true self would extend (...) concern beyond the narrow selves we appear to be. The neo-Confucians held just such a view. They espoused an identity with the universe and everything in it, arguing that this identity explains a natural concern for everyone and everything, not just for our narrow selves. However, many things in the universe differ from each other, that is, some have qualities others lack. If they are all one and the same thing then that one thing differs from itself. I will suggest that the objection can be answered with some metaphysical innovation. I will address the objection by sketching a theory--call it the theory of aspects--that explains how numerically identical things can differ qualitatively. (shrink)

Radical Behaviorism makes the implausible claim that “the appeal to mind explains nothing at all” (Skinner 1971, p. 186). Clearly, such a claim (if accepted) would lend strong support to the Skinnerian research program, if only because it would eliminate the major competition. But what support remains when such a claim is not accepted? This paper shall argue that the Skinnerian research program need not depend upon the supposition that there is something scientifically illicit or vacuous about the explanations offered (...) by mentalistic psychology. Distinguishing Radical Behaviorism from a position that grows out of Skinner’s writings from 1938 through 1950, it asserts that the latter position provides a conception of the behavior analytic program that is compatible with the basic claims of cognitive and folk psychology.We may give a rough definition of this position by following Cummins (1983) in distinguishing between two types of scientific theory. In this work, a neo-classical relativistic mechanics theory is presented where the spin of an electron is an inherent part of its world space-time path as a point particle. The fourth-order equation of motion corresponds to the same covariant Lagrangian function in proper time as in special relativity except for an additional spin energy term. The theory provides a hidden-variable model of the electron where the dynamic variables give a complete description of its motion, giving a classical mechanics explanation of (...) the electron’s spin, its dipole moments, and Schrödinger’s zitterbewegung, These features are also described mathematically by quantum mechanics theory, of course, but without any physical picture of an underlying reality. The total motion of the electron can be decomposed into a sum of a local spin motion about a point and a global motion of this point, called here the spin center. The global motion is sub-luminal and described by Newton’s Second Law in proper time, the time for a clock fixed at the spin center, while the total motion occurs at the speed of light c, consistent with the eigenvalues of Dirac’s velocity operators having magnitude c. The local spin motion is an inherent perpetual motion, which for a free electron is periodic at the ultra-high zitterbewegung frequency and its path is circular in a spin-center reference frame. In an electro-magnetic field, this spin motion generates magnetic and electric dipole energies through the Lorentz force on the electron’s point charge. The electric dipole energy corresponds to the spin-orbit coupling term involving the electric field that appears in the corrected Pauli non-relativistic Hamiltonian, which has long been used to explain the doublet structure of the spectral lines of the excited hydrogen atom. Pauli’s spin-orbit term is usually derived, however, from his magnetic dipole energy term, including also the effect of Thomas precession, which halves this energy. The magnetic dipole energy from Pauli’s and Dirac’s theory is twice that in the neo-classical theory, a discrepancy that has not been resolved. By defining a spin tensor as the angular momentum of the electron’s total motion about its spin center, the fundamental equations of motion can be re-written in an identical form to those of the Barut–Zanghi electron theory. This allows the equations of motion to be expressed in an equivalent form involving operators applied to a state function of proper time satisfying a neo-classical Dirac–Schrödinger spinor equation. This state function produces the dynamic variables from the same operators as in Dirac’s theory for the electron but without any probability implications. It leads to a neo-classical wave function that satisfies Dirac’s relativistic wave equation for the free electron by applying the Lorentz transformation to express proper time in the state function in terms of an observer’s space-time coordinates, showing that there is a close connection between the neo-classical theory and quantum mechanics theory for the electron’s dynamics. My aim is to illustrate that a Neo-Soul Politics would be much more helpful in bringing about the kinds of practical and effective democratic reforms the black community so urgently needs. A Neo-Soul Politics is an ontological, epistemological, and methodological approach toward freedom and problem solving that expands beyond instrumental rationalism and liberal ideals about politics (...) in general.
